The Bureau of Labor Law sets and enforces the prevailing and living wage, and benefit rates for workers, laborers, and mechanics employed on New York City Public Work projects as well as building service employees on City contracts and certain properties that receive tax exemptions, in accordance with its mandate under state law. The goal of the Worker’s Rights Bureau is to build upon the work that the BLL already does to combat wage theft to expand worker’s rights and enforcement through legislation, policy, procurement, and corporate shareholder engagement initiatives, while strengthening the office’s outreach strategies to educate New Yorkers on their labor rights.

We are seeking a motivated law graduate to assist the Bureau of Labor Law in its enforcement of prevailing wage laws. The law graduate will manage their own caseload of investigations and perform litigation work under the guidance of their Supervising Attorney.

Responsibilities include, but are not limited to, the following:

- Conducting prevailing wage investigations by issuing subpoenas, interviewing witnesses, and analyzing documents;

- Negotiating settlement agreements securing back pay for workers;

- Under supervision, representing the Office of the Comptroller in proceedings at the NYC Office of Administrative Trials and Hearings (OATH). This includes participating in settlement conferences, hearings, drafting legal memoranda, and preparing for and conducting trials;

- Performing legal research concerning the enforcement of prevailing wage laws in NYC and other worker protection laws;

- Performing other related work or special projects as needed, including outreach and education, presentations to stakeholders, and helping the office implement new laws such as Real Property Tax Law Section 485-x and the Construction Justice Act.


Note:

1. As a condition of continuation of employment, law school graduates selected for the position must attain admission to New York State Bar within 2 years of their employment start date.

2. Incumbents admitted to the New York State Bar must remain members of the Bar in good standing for the duration of this employment.

Qualifications

Graduation from an accredited United States law school as defined in the Rules of the New York Court of Appeals (Sections 520.3 or 520.5) or admission to the New York State Bar.
