Role PositioningÂ
Under the Care Standards Act 2000, the Responsible Individual sits within the provider’s legal accountability framework.Â
The RI reports directly to the Registered Provider or Board of Directors and acts as the provider’s regulatory and safeguarding representative to Ofsted.Â
This role extends beyond compliance monitoring. The RI provides:Â

- Constructive professional challengeÂ
The RI ensures the service is not simply compliant, but defensible, sustainable, and child-centred.Â
Core AccountabilityÂ
The Responsible Individual is accountable for ensuring that the children’s home:Â
- Operates lawfully under all relevant legislationÂ
- Meets and sustains the Quality StandardsÂ
- Maintains safe, proportionate safeguarding systemsÂ
- Remains inspection-ready under the Social Care Common Inspection FrameworkÂ
- Delivers measurable outcomes for childrenÂ
The RI represents the provider in regulatory engagement and must be able to evidence oversight, scrutiny, and challenge.Â
Strategic FunctionsÂ
A. Governance & Regulatory AssuranceÂ
- Maintain provider-level oversight systemsÂ
- Monitor trends in incidents, restraints, missing episodes, complaints and safeguardingÂ
- Oversee Regulation 44 independence and scrutiny qualityÂ
- Review and approve Regulation 45 Quality of Care reportsÂ
- Ensure Regulation 40 notifications are appropriate and timelyÂ
- Maintain a live compliance and risk registerÂ
- Stress-test systems prior to inspectionÂ
The RI ensures governance systems are proactive rather than reactive.Â
Oversight is based on documentation, disclosures, and information made available by the service at the time of review. The provider retains ultimate legal responsibility for operational delivery and regulatory compliance.Â
B. Safeguarding LeadershipÂ
The RI:Â
- Holds ultimate safeguarding accountability on behalf of the providerÂ
- Scrutinises serious incidents and allegationsÂ
- Ensures appropriate external referrals (LADO, police, placing authority)Â
- Monitors learning and practice improvementÂ
- Ensures safeguarding decisions are evidence-based and defensibleÂ
Where safeguarding concerns arise and provider action is deemed inadequate, the RI reserves the right to escalate concerns to Ofsted or relevant safeguarding authorities in line with statutory responsibilities.Â

C. Leadership Oversight & CultureÂ
- Provide structured supervision to the Registered ManagerÂ
- Offer professional challenge and performance scrutinyÂ
- Identify early indicators of drift, fatigue, or compliance riskÂ
- Monitor workforce stability, safer recruitment, and training complianceÂ
- Ensure the Statement of Purpose reflects operational realityÂ
The RI supports a culture of transparency, reflection, and accountability.Â
D. Inspection Readiness & Risk AnticipationÂ
The RI ensures the home remains prepared for inspection by:Â
- Reviewing evidence trails against SCCIF judgement areasÂ
- Overall experiences and progress of childrenÂ
- How well children are helped and protectedÂ
- Effectiveness of leaders and managersÂ
- Evaluating documentation quality and regulatory languageÂ
- Identifying vulnerabilities before inspectionÂ
- Ensuring improvement plans are outcome-focusedÂ
Inspection readiness is continuous, not seasonal.Â
Measurable Performance IndicatorsÂ
The effectiveness of the RI function may be evidenced by:Â
- No avoidable regulatory breachesÂ
- Timely and accurate statutory notificationsÂ
- Reduction in recurring safeguarding themesÂ
- Consistent Regulation 44 quality and independenceÂ
- Clear, evidence-based Regulation 45 reportsÂ
- Demonstrable improvement following action plansÂ
- Positive inspection feedback regarding governance and oversightÂ
The RI provides structured oversight reporting to the provider quarterly (minimum).Â
Independence & Conflict of InterestÂ
- The RI operates independently of day-to-day managementÂ
- The RI will not undertake direct operational shift deliveryÂ
- Any prior consultancy involvement will be transparently declaredÂ
- Clear boundaries will be maintained between improvement consultancy and statutory oversightÂ
- Financial or professional conflicts of interest will be formally declaredÂ
The RI retains professional authority to challenge the provider where necessary.Â

- The RI provides governance oversight, not operational managementÂ
- The Registered Manager retains responsibility for day-to-day runningÂ
- The provider retains ultimate legal responsibilityÂ
- The RI role does not guarantee inspection outcomesÂ
- Oversight is based on information disclosed and made available at the time of reviewÂ
Fees reflect professional expertise and governance oversight. Inspection outcomes remain the responsibility of the provider.Â
Professional RequirementsÂ
- Enhanced DBS including Children’s Barred List checkÂ
- Level 5 Diploma in Leadership & Management (Children’s Residential) or demonstrable equivalent senior leadership experienceÂ
- Significant senior leadership experience in children’s residential careÂ

Travel to services across UK regions will be required. Mileage and reasonable travel expenses may be chargeable in line with the agreed consultancy contract.Â
 Ethical StatementÂ
The Responsible Individual’s primary duty is to children’s safety and welfare.Â
Commercial interests must never override safeguarding responsibilities.Â
Delphi Care Solutions will not support or remain engaged with services where safeguarding standards fall below acceptable statutory thresholds without clear, measurable improvement action.Â
