OBJECTIVES: 


The objective of this consultancy is to develop: (i) a comprehensive, evidence-based research study on holistic reparations, particularly in cases of sexual violence; and (ii) a position paper articulating key standards, good practices, gaps, and recommendations to advance survivor-centered and rights-based reparations.

The research will analyze judicial and extrajudicial forms of comprehensive reparation, including the design, implementation, accessibility, enforcement, and practical impact of reparation measures. It will examine how such measures are experienced by victims and survivors, including their responsiveness to diverse social, cultural, and contextual realities.

The study will draw on existing reports, jurisprudence, international and regional standards, institutional practices, and relevant experiences at the national, regional, and international levels. 

The position paper will build on these findings to articulate key principles and approaches regarding holistic, survivor-centered, culturally relevant, and rights-based reparations. It will include relevant standards, promising practices, and recommendations to strengthen effective reparations across law, policy, litigation, and implementation.

The consultant will engage in a participatory process, including consultations and interviews with victims and survivors, litigating organizations, national justice operators, Equality Now team members, and experts from international and regional human rights mechanisms.


During the contract period, the Consultant will deliver the following: 

  • Develop an inception note outlining the proposed methodology, analytical framework, work plan, and timeline.
  • Conduct a comprehensive desk review of existing reports, studies, jurisprudence, standards, and relevant materials concerning holistic reparations, particularly in cases of sexual violence.
  • Review and analyze relevant international and regional human rights standards and jurisprudence, including those from the Inter-American Commission on Human Rights, the Inter-American Court of Human Rights, the CEDAW Committee, the Human Rights Committee, and the European Court of Human Rights.
  • Conduct a detailed analysis of the Inter-American Court of Human Rights’ compliance monitoring processes, with particular attention to the implementation and operationalization of reparation measures in cases involving gender-based violence.
  • Identify and analyze judicial and extrajudicial reparation measures adopted in the national contexts, including their implementation, accessibility, enforcement, and practical effectiveness.
  • Conduct virtual consultation meetings with regional networks.
  • Conduct interviews with litigating organizations, national justice operators, and experts from international and regional human rights mechanisms and bodies. 
  • Conduct interviews with victims and survivors, applying ethical principles, ensuring confidentiality, informed consent, non-revictimization, and a survivor-centered approach.
  • Identify and document promising practices, implementation challenges, institutional barriers, and lessons learned regarding holistic reparations in practice.
  • Prepare a comprehensive research study/systematization on modalities of holistic reparations, particularly in cases of sexual violence.
  • Draft a position paper articulating key principles, standards, implementation gaps, and recommendations regarding survivor-centered and rights-based reparations.
  • Revise the draft documents based on feedback from Equality Now and partner organizations and networks.
  • Facilitate a validation process with relevant stakeholders.
  • Submit final, high-quality deliverables.


DELIVERABLES

1- Inception Note -  An inception note outlining the proposed methodology, analytical framework, work plan, timeline, and ethical considerations for engaging with survivors of violence.

2- Interview Findings and Systematization Report - A report compiling and systematizing key findings from interviews conducted with litigating organizations, national justice operators, experts from international and regional human rights mechanisms and bodies, as well as victims and survivors, ensuring confidentiality and survivor protection standards.

3- Research Study/Systematization Report -  A comprehensive research study/systematization on modalities of holistic reparations, particularly in cases of sexual violence, including comparative analysis, promising practices, challenges, and lessons learned.

4- Position Paper -  A position paper articulating key principles, international standards, implementation gaps, and actionable recommendations regarding survivor-centered and rights-based reparations.

REPORTING AND COORDINATION:

The consultant will work closely with the Senior Legal Adviser and the Regional Representative for LAC.


DURATION:

This is a four (4) months consultancy 


PAYMENT:

Consultancy fees will be paid in 2 installments upon receipt of an invoice, subject to satisfactory completion and approval of agreed deliverables, and in line with Equality Now’s consultancy policies. 


CONSULTANT PROFILE & QUALIFICATIONS:

Education and Experience

● Advanced university degree in law, human rights, gender studies, international relations, or a related field.

● At least 5 years of relevant professional experience in human rights, gender equality, access to justice, and reparations, particularly in relation to gender-based violence and/or sexual violence.

● Demonstrated expertise in conducting legal, policy, and qualitative research, including the analysis of jurisprudence, institutional practices, and implementation processes.

● Proven experience drafting high-quality analytical, policy, advocacy, or research documents, including reports, position papers, legal analyses, or similar publications.

● Strong knowledge of international and regional human rights frameworks related to gender-based violence, sexual violence, access to justice, and reparations.

● Experience analyzing judicial and/or extrajudicial reparation measures and their implementation in practice, preferably in national or comparative contexts.

● Experience conducting interviews, consultations, or participatory research processes with diverse stakeholders, including civil society organizations, survivors, justice sector actors, and/or international human rights experts.

● Experience working collaboratively with civil society organizations, networks, or coalitions in Latin America and the Caribbean.

Technical and Functional Skills

● Strong research and analytical skills, including the ability to synthesize complex legal, institutional, and policy frameworks.

● Excellent writing skills in Spanish, with the ability to produce clear, rigorous, and advocacy-oriented analytical documents for diverse audiences.

● Ability to analyze the implementation and practical impact of laws, policies, judicial decisions, and reparation measures.

● Familiarity with international and regional human rights standards, mechanisms, and jurisprudence, particularly concerning reparations and gender-based violence.

● Ability to conduct interviews, facilitate consultations, and incorporate diverse stakeholder perspectives into analytical and advocacy documents.

● Strong organizational, coordination, and time-management skills, with the ability to work independently and meet deadlines.
